BatWiser Terms of Use

Welcome to BatWiser. These Terms of Use (“Terms”) govern your use of the BatWiser application and website (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Use of the Service

Eligibility You must be at least 13 years old to use our Service. By using BatWiser, you represent and warrant that you are at least 13 years of age.

Account Registration To access certain features of the Service, you may need to register for an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date.

User Responsibilities You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. License and Restrictions

License Grant Subject to your compliance with these Terms, BatWiser grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

Prohibited Activities You agree not to:

• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
• Modify, adapt, translate, or reverse engineer any portion of the Service.
• Use any robot, spider, site search/retrieval application, or other automated device to retrieve or index any portion of the Service.
• Attempt to gain unauthorized access to any portion of the Service or any other accounts, computer systems, or networks connected to the Service.

3. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, and images, are the exclusive property of the BatWiser developer  – Yevhen Zakharov or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. Termination

We may terminate or suspend your access to the Service, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

5. Disclaimers and Limitation of Liability

Disclaimers The Service is provided on an “as-is” and “as-available” basis. BatWiser makes no warranties, expressed or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability To the fullest extent permitted by applicable law, BatWiser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
